These Terms of Service ("Terms") are an agreement between you and The Ledger Tech LLC ("we", "us", "The Ledger"), the company that runs The Ledger. They are written to be read.
By creating an account or using the app, you agree to these Terms and to the Privacy Policy. If you do not agree, please do not use The Ledger.
The Ledger is bookkeeping software for rental property owners. It keeps your entries, mileage, leases, loans and papers, reads the papers you give it, and produces statements and packages from your records. It also offers a tenant portal and, on Premium, rent paid online through Stripe (section 12).
The Ledger is bookkeeping software. It is not a tax, legal, accounting or financial adviser, and nothing in it is advice. Every tax figure is a draft - review it with your CPA before you file. We are not a CPA, a law firm, a financial adviser or a consumer reporting agency.
The Ledger reads your papers with automated tools that can make mistakes. You confirm every figure, place and category before you rely on it.
You can invite other people (such as a partner, bookkeeper or CPA) to a specific property. You control those invitations and are responsible for the access you grant - invitees can see that property's records, including any tenant details on it. Remove access when it is no longer needed.
Features, including anything marked beta, may change or stop. The app may be unavailable at times. Keep your own backups - you can export everything at any time.
Google, Stripe and Brevo run parts of the service. We are not responsible for their outages.
Your data stays yours. You give us permission to store, copy and process it only to run the service for you - to keep it, read your papers, show it to the people you share it with, and back it up. The software, the name and the design are ours. If you send us feedback, we may use it without paying you.
Rent paid online goes through Stripe to your own Stripe account. The Ledger never holds your money, is not a bank or payment processor, and is not a party to your lease. Stripe's terms apply. Returns, disputes and chargebacks are between you, your tenant and Stripe.
If a landlord invites you to the tenant portal, these Terms apply to your use of it. The portal lets you pay, message your landlord, report a repair and apply for a rental. Your lease, your rent and any decision on an application are between you and your landlord - The Ledger is not the landlord, the property manager or a screening company, and it does not run credit or background checks.
We send service emails about your account, your plan and your payments. Emails a landlord sets up for tenants (invitations, reminders, receipts, charge notices) go out on that landlord's behalf, and the landlord is responsible for them. Other emails - updates, the beta invitation - go only to people who ask for them or whom we invite personally, and every one carries a one-click unsubscribe and our postal address.
THE LEDGER IS PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND ACCURACY.
TO THE FULLEST EXTENT THE LAW ALLOWS, THE LEDGER TECH LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR LOST-PROFIT DAMAGES, INCLUDING TAX PENALTIES, INTEREST OR THE COST OF AMENDED RETURNS, ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM IS CAPPED AT THE GREATER OF WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.
You agree to cover us (defend and hold us harmless) against claims from your tenants, applicants, co-owners or anyone else arising from your use of the app, your content or your breach of the law.
You can export everything and delete your account at any time from within the app (Account → delete). After an account closes, its data is deleted as the Privacy Policy says.
We will tell you about changes by email or in the app. A material change takes effect 30 days after we tell you; using the app after that means you accept it. The date at the top shows the current version.
If a part of these Terms can't be enforced, the rest still applies. These Terms and the Privacy Policy are the whole agreement between us about the app. Not enforcing a part is not a waiver of it. You may not transfer these Terms; we may transfer them with the business. Neither of us is responsible for delays caused by events beyond reasonable control.
